Recently, the government has published a new consultation called “Planning performance and planning contributions” which is looking at was to scrutinise Local Planning Authorities who are underperforming.
One of the chief concerns our clients have when starting out on a new development, is the uncertainty and real subjectivity used by planners. If the consultation is successful there might finally be a mechanism for some sort of enforcement against LPAs who don’t perform. It will also seek to limit an LPA’s ability to insist on planning obligations under s106 for small scale developments or regeneration.
The consultation closes on 4 May 2014.
